Managing Employees with a Suspected Mental Health Condition

The speakers will discuss the prevalence of mental health problems in the workplace, how management and employers can prepare to address an employee with a suspected mental health condition, how to recognize the signs of potential mental health disabilities, the employer’s and employee’s obligations under federal and California law, the interactive process, and possible accommodations. 

 

Speakers: Kimberley Worley & Susana Solano

Kimberley Worley has over 25 years of experience representing employers in matters ranging from individual discrimination, harassment, wrongful termination, and retaliation, to wage and hour compliance and general employment law concerns. She is a successful litigator and has guided numerous cases through all stages of litigation, from inception to successful conclusion, whether through law and motion, mediation, arbitration, jury trial, bench trial, or appeal. Ms. Worley has defended her clients in both state and federal courts, as well as arbitration and administrative hearings before the DLSE, DOL, DFEH, and EEOC. She has sat first chair on jury and bench trials in state court, federal court, and arbitration.

 

Susana Solano advises employers and management regarding issues arising out of the employee-employer relationship, including the prevention of employment discrimination, retaliation, harassment, wrongful termination, and wage and hour violations. She assists employers in developing policies and practices that comply with state or federal law and preparing employee handbooks, agreements to arbitrate, class action waivers or employment contracts. She also offers training on wage and hour compliance, medical leaves, accommodations and prevention of discrimination and harassment in the workplace. She is fluent in Spanish and has experience drafting policies and contracts in Spanish and conducting interviews of monolingual Spanish witnesses. She defends employers before various administrative agencies, such as the Labor Commissioner and Department of Fair Employment and
Housing.
