The Evolving Landscape of AB 5 and Independent Contractor Classifications

The session will cover California’s AB 5, which went into effect January 1, 2020, and recent developments, litigation, and legislation related to the new law. Topics will include: a. A brief review of the law and its relation to the Dynamex decision b. A review pertinent exemptions to the law and tips for employers regarding how to interpret those exemptions c. Guidance for employers that are reclassifying independent contractors as employees d. An overview of additional industries that are seeking exemptions through legislation, including the effects of COVID-19’s disruption to pending legislation e. Overview of important court decisions regarding interpretation/implementation of AB 5 and/or Dynamex (for example, California Trucking Association et al. v. Xavier Becerra et. al., International Brotherhood of Teamsters where the Southern District of California granted California Trucking Association’s request for a preliminary injunction enjoining the enforcement of AB 5 where applied to certain truck drivers)



































































Nathan W. Austin is a Principal in the Sacramento, California, office of Jackson Lewis P.C. He joined the Firm in 2006.

Mr. Austin's practice consists of defending employment matters in state and federal courts, arbitrations and administrative proceedings. He also defends management in litigation involving wrongful termination, discrimination, harassment, breach of contract, wage and hour, benefits and other employment-related actions. In addition, Mr. Austin provides training for managers and employees on various workplace issues.

Prior to joining Jackson Lewis, Mr. Austin was an associate with a mid-sized Sacramento-based law firm successfully representing clients in employment law, ADA law, property disputes, and general tort litigation. He was also a trial attorney with mid-sized California real estate law firm, representing management and property owners in landlord/tenant law handling all facets of unlawful detainer litigation.
Erika Barbara Pickles is Of Counsel in the Sacramento, California, office of Jackson Lewis P.C. She represents employers in workplace law matters, including preventive advice and counseling.

Ms. Pickles has defended employers in employment litigation, class actions, and arbitrations. Her practice has involved the full range of workplace-related claims, including but not limited to: wage and hour; discrimination, harassment and retaliation; and wrongful termination. She also assists employers in investigating and responding to administrative complaints before the California Department of Fair Employment and Housing and the U.S. Equal Employment Opportunity Commission.

Ms. Pickles focuses on prevention by providing clients with advice and counseling, handbook reviews, and trainings.
In addition to her current position in Jackson Lewis’ Sacramento office, Ms. Pickles was a member of Jackson Lewis’ San Francisco office. She also served as employment law counsel and labor law advisor with the California Chamber of Commerce, the state’s largest employer association.
While attending law school, Ms. Pickles received awards for legal writing, was on the Board of Directors of the Moot Court Honors Program and participated in the Advocate of the Year Advanced Moot Court Competition. She also studied abroad at Trinity College in Dublin, Ireland and Charles University in Prague, Czech Republic.
