This webinar explores the cutting-edge legal concerns emerging with employee mobile devices used for work.  This webinar focuses on Cochran v. Schwan's Home Service, Inc. (2014) 228 Cal.App.4th 1137, review denied (Nov. 25, 2014).  In Cochran, the California Court of Appeal issued the sweeping decision that California Labor Code section 2802 requires employers to reimburse employees who are required to use personal cell phones for work-related calls for a “reasonable percentage” of their cell phone bills.  Reimbursement applies even when employees have cell phone plans with unlimited minutes or a third party pays for such plans. 

 

In addition, the webinar addresses legal concerns associated with employee mobile devices.  For example, legal concerns associated with social media on mobile devices and trade secrets on an employee’s smart phone.  The webinar seeks to provide practical solutions and real-world insights to assist attendees in tackling these concerns.

SPEAKER BIO

Elizabeth Stallard is a Partner at Downey Brand LLP. Banks, mall owners, trade associations, manufacturers, and other businesses and individuals rely on Elizabeth for counsel in disputes with employees, business associates, and customers, in subject areas ranging from intellectual property to breach of contract to fraud and qui tam claims to environmental contamination. She has also been involved in the defense of several class actions, including currently serving as lead counsel in a class action involving ADA accessibility at a major hospital group.


Elizabeth has experience in all aspects of state and federal civil litigation at both the trial and appellate level, including discovery, motion practice, and alternative dispute resolution. She has represented clients involved in investigations by the EEOC, DOJ, SEC, FAA, and other agencies, as well as represented those clients in related state and federal litigation and administrative proceedings. Elizabeth also has a long and demonstrated record of successful and effective advocacy in front of state and federal courts in both California and Nevada, including serving as lead trial counsel in both states.


Elizabeth received a B.A. from Williamette University in 1997 and a J.D. from the New York University School of Law in 2002.

  Johnny A. Colón is an Associate at Downey Brand LLP.
