Managing workplace misconduct can be complex and challenging, especially if an employee is on a leave of absence or has a disability. In this session, we will review the legal protections applicable to these employees, and the steps an employer can take to effectively manage their work performance. We will dispel common myths (such as, “You cannot fire anyone on a leave of absence” and “You cannot discipline employees for violating our workplace violence prevention policy if they take medication.”).
Attendees will learn strategies for enforcing their internal policies and procedures in these situations without creating unnecessary legal risk. Take-aways will include a checklist/flowchart.

- Understand the basic requirements of state leave laws
- Understand the basic requirements of state disability laws
- Learn how to use key tools to manage the workplace misconduct of employees with disabilities and/or leave of absence protections
