Terminations are never easy from an operational and emotional perspective and can be legal quagmire even when handled correctly. In this informative and interactive session, we'll review the fundamentals of sound disciplinary procedures, revisit the legal issues that any termination calls into play, and learn valuable and practical steps that we should all take to make terminations go as smoothly as possible - for the person being terminated and for the company.

Learning Objective:

  • A review of the concept of at-will employment and how it can be eroded under various doctrines that vary from state to state.
  • A review of key types of employment claims that employers want to avoid: discrimination, defamation, violation of public policy, breach of contract, etc.
  • Practical how-to's for managing the disciplinary process.
  • Practical how-to's for creating a strong case for a termination.
