Did you pay break premiums AND bonuses? California has a penalty for that, too. This presentation will discuss the California Supreme Court’s recent decision in Ferra v. Loews, which holds that meal and rest period premiums must be paid at the employee’s regular rate of pay. This presentation will further cover the other new wage and hour laws that went into effect in 2021, including off-the-clock concerns, mandatory security checkpoints, and meal period requirements. Finally, this presentation will also provide a refresher on some previously existing Labor Code requirements that are now becoming more prominent due to the COVID-19 pandemic, such as reporting time pay for health screening, and business expense reimbursement for remote workers.
Nate Jenkins counsels clients in labor and employment law matters. Prior to joining Littler, Nate worked as an in-house attorney to a State of California Workforce Development Agency, where he regularly advised an eight-member panel and executive staff on a broad range of personnel issues affecting public sector employees.
