When conducting workplace investigations, investigators are often called upon to make factual determinations about conflicting versions of relevant events. To do so, investigators must continually evaluate the credibility of parties and witnesses throughout the investigation. This session will use real-world case studies to discuss key factors investigators use to assess credibility. The session will also review how these factors are applied when conducting remote investigations, and options for including credibility assessments in investigative reports.
SPEAKERS Alex Sperry is a Sacramento, California-based attorney investigator. Having spent his entire career as an employment lawyer, Alex has developed a keen understanding of workplace dynamics and issues affecting employer-employee relationships. For many years, Alex provided labor and employment law counseling and litigation services to clients. Since 2013, Alex’s practice has focused on conducting impartial workplace investigations. He investigates a variety of allegations for both public and private employers, ranging from harassment, discrimination and retaliation, to bullying, workplace violence, and failure to accommodate, fraud, and employee misconduct. Alex is an active member of the Association of Workplace Investigators (AWI), where he frequently trains others in the specialized knowledge and skills required to successfully conduct impartial workplace investigations. Alex was previously a Partner with Van Dermyden Maddux Law Corporation, an investigations law firm. He opened his own investigations and training practice in October 2017.
Shannon Shrewsbury is an employment attorney whose practice focuses exclusively on conducting impartial workplace investigations throughout California. Shannon conducts complex and sensitive investigations in both the private and public sectors, and regularly investigates claims of discrimination, harassment, retaliation, bullying and employee misconduct. Shannon currently serves as Co-Chair of the Association of Workplace Investigators Seminar and Webinar Committee, and also serves on the Advisory Committee for the Voluntary Legal Services Program of Northern California. Prior to opening her own investigations practice, Shannon advised and represented public and private employers in a range of labor and employment matters.
