Employers are often sued because of technical violations that occur simply because the employer is unaware of its legal obligations. In this presentation, we seek to provide key insight to helping you avoid any such violations. The presentation will cover:

Lukas Clary is a shareholder in the Firm’s Labor & Employment and Litigation practice groups and serves as the Firm’s Marketing Shareholder.  Lukas has experience representing clients in all aspects of Employment Litigation.  He regularly handles claims involving allegations of workplace discrimination, harassment, retaliation, wrongful termination, unpaid overtime and wages, missed meal and rest periods, and class actions.  Lukas also regularly counsels employers on compliance and litigation avoidance strategies, including leave management and the interactive process associated with accommodating employees with disabilities.  He also helps his clients craft employee handbooks and employment policies.

Managers must get results through other people. People don’t produce well when they are uncertain, anxious, envious, insecure, angry, etc. Research consistently reveals that what managers do and say determines how their employees feel. We will analyze common situations that create emotional turbulence and construct messages that add “need-fulfilling” ingredients into the message content. Adding these person-validating “ingredients” will deepen the positive impact of leadership’s everyday communication—even when the manager is having to deliver bad news.

How Has Covid-19 Altered Investigations? 
The COVID-19 Pandemic has affected investigations in both tangible and intangible ways.  Understanding the lessons learned during this experience and be prepared to adapt and evolve to what is likely the investigation methods of the future.  Investigators must be open to and develop techniques for conducting interviews using methods other than in-person interaction.  This presentation will address some of the basic concerns that arise when conducting interviews in a less formal setting such as video conferencing, including remaining disciplined in your preparation and approach, retaining the professional atmosphere that the circumstances require, and avoiding distractions of your new work space.

Kimberley Worley has over 25 years of experience representing employers in matters ranging from individual discrimination, harassment, wrongful termination, and retaliation, to wage and hour compliance and general employment law concerns. She is a successful litigator and has guided numerous cases through all stages of litigation, from inception to successful conclusion, whether through law and motion, mediation, arbitration, jury trial, bench trial, or appeal.  Ms. Worley has defended her clients in both state and federal courts, as well as arbitration and administrative hearings before the DLSE, DOL, DFEH, and EEOC. She has sat first chair on jury and bench trials in state court, federal court, and arbitration.

In this session, we will explore financial equality as an important DEI issue.  Workplace Financial Wellness is not a one-size-fits-all solution.  We’ll look at examples of how gaps in inclusion can cause financial inequality, and learn new ways to level the playing field, so individuals and companies can thrive.
