Following their summer recess, our California legislators jumped right back into business. Advocacy efforts did not stop during the summer break. Instead, SHRM and CalSHRM continued their efforts to influence changes in the laws: locally against the proposed CFRA amendments, and nationally against proposed FSLA regulations that have California specific impact.
At the time of submission, the bill to amend the California Family Rights Act (CFRA), SB 406, passed the Assembly appropriations committee in late August, has been read and amended once, ordered to a second reading and has now been ordered to a 3rd reading. CalSHRM believes that while the bill is well intentioned, it is greatly flawed. CalSHRM’s Opposition Letter was sent to every member of the Assembly outlining specific reasons for opposition to the bill following its passage out of appropriations, including opposing the drop from 50 employees to 25 for an employer to be covered as well as the expansion of covered family members. September 11th is the deadline for bills to pass the legislature, so individuals are still encouraged to contact your local representatives to voice concerns over the bill.
In regards to the proposed FLSA regulations, at the time of submission, SHRM and CalSHRM were in the process of finalizing comments in a letter to be sent to the DOL outlining California specific impacts of the proposed changes to the exemption parameters for executive, administrative, and professional employees, among others, to $970 per week. CalSHRM outlined that while a change is justified, the proposal is too high, higher than the current California threshold, and would cause reclassification and cost concerns for California employers. Comments were to be submitted by close of business on Friday September 4th.
